What personal information we collect from clients and prospective clients, why we collect it, who we share it with, and the choices you have.

This Privacy Policy explains how the REMAX Hallmark® Group of Companies, including REMAX Hallmark® Realty Ltd., Brokerage and the affiliated REMAX Hallmark® franchise offices in Ontario, Canada and Naples, Florida (together, “REMAX Hallmark®,” “we,” “us”), collects, uses, discloses, and protects personal information through this website, our client portal, and the contact forms we operate. It is written to meet our obligations under Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario law, and to give Florida users a clear account of the same practices.
1. Who is responsible for your information
REMAX Hallmark® is the organization accountable for the personal information collected through this website. Each REMAX Hallmark® office is an independently owned and operated franchise, and individual REMAX Hallmark® REALTORS® are separately responsible for information you provide to them directly in the course of a real estate transaction. Our Privacy Officer can be reached at privacy@remaxhallmark.com.
2. Information we collect
We collect only what we need for the purposes described in this policy.
Information you give us
- Your name, email address, phone number, and the content of your message when you submit a listing inquiry, showing request, callback request, home valuation request, general contact form, or careers/join inquiry.
- Account details when you register for the client portal: your name, email, phone, and a password (stored only in hashed form by our authentication provider).
- Your saved listings, saved searches, and preferences within your portal account, and any connection you make with a REMAX Hallmark® REALTOR®.
Information collected automatically
- Standard technical data: IP address, browser type, device type, operating system, referring website, and the pages you view on our site.
- Cookies and similar technologies, as described in our Cookie Policy. Analytics and marketing cookies are only set with your consent.
Information from third parties
- Real estate listing data supplied by the MLS® boards we participate in (the Toronto Regional Real Estate Board, the Information Technology Systems Ontario platform, and the Naples Area Board of REALTORS®), delivered through our data provider.
- Referral information from a REMAX Hallmark® REALTOR® or office when you have asked them to connect you with our team.
3. How we use your information
- To respond to your inquiry and connect you with an appropriate REMAX Hallmark® REALTOR®.
- To arrange property showings and follow up on your real estate interest.
- To create and operate your client portal account, including your saved listings and favourites.
- To send you transactional messages (for example, account confirmation, password reset, or a reply to your request).
- With your consent, to send you market updates, new-listing alerts, and other marketing communications, which you can stop at any time.
- To operate, secure, and improve the website, and to detect and prevent fraud, abuse, and automated scraping.
- To meet our legal, regulatory, and professional obligations, including those under Ontario’s Trust in Real Estate Services Act, 2002 and its predecessor legislation, and record-keeping requirements that apply to real estate brokerages.
4. Consent
We collect, use, and disclose your personal information with your consent, which may be express or implied depending on the sensitivity of the information and the circumstances. By submitting a form or creating an account, you consent to the practices described here. You may withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice, by contacting privacy@remaxhallmark.com. Withdrawing consent may mean we can no longer provide certain services, such as the client portal or listing alerts.
5. When we share information
We do not sell your personal information. We share it only as follows:
- With REMAX Hallmark® REALTORS® and offices so that a licensed representative can respond to your request and assist you.
- With service providers who process information on our behalf and under contract, including our website and database hosting providers, our transactional email provider, our bot-protection (captcha) provider, our mapping and address-lookup provider, and our MLS® data provider. These providers are permitted to use the information only to deliver their service to us.
- With MLS® boards where their rules require it in connection with listing data and our Virtual Office Website.
- Where required or permitted by law, including to comply with a subpoena, court order, or lawful request from a regulator or law enforcement, or to protect our rights, safety, or property.
- In a business transaction, such as a merger, financing, or sale of assets, in which case information would be handled under this policy or a successor policy of comparable protection.
6. Where your information is stored
Our hosting and service providers may store and process personal information on servers located in Canada and the United States. When information is held in another country, it is subject to the laws of that country, and may be accessible to courts, law enforcement, and national security authorities there. By using this website you consent to this transfer and processing.
7. How long we keep it
We keep personal information only as long as necessary for the purpose it was collected and to meet legal and professional retention requirements. Inquiry and lead records are retained while there is an active or reasonably anticipated relationship and for a reasonable period afterward. Real estate transaction records are retained for the period required of brokerages under applicable law. Client portal accounts are kept until you ask us to close the account, after which they are deleted or de-identified within a reasonable time, except where retention is legally required.
8. How we protect it
We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including encryption of data in transit, access controls, row-level database security in our portal, and automated bot protection on our forms. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Your choices and your rights
- Access and correction. You may ask for a copy of the personal information we hold about you and ask us to correct anything inaccurate or incomplete.
- Deletion. You may ask us to delete personal information we no longer need to retain.
- Withdraw consent. You may withdraw consent to our use of your information, as described in Section 4.
- Marketing. You may unsubscribe from marketing email at any time using the link in the message, or by contacting us.
- Portal self-service. You can review and remove your saved listings and update your profile directly in the client portal.
To exercise any of these rights, contact our Privacy Officer at privacy@remaxhallmark.com or use our Data Protection page. We will verify your identity and respond within 30 days, or tell you if we need more time. There is no charge for a routine request.
10. Listing accuracy and removal requests
If you believe a property is being advertised with incorrect information, or that a listing should no longer be displayed (for example, it has sold, leased, or been withdrawn, or the owner has asked to limit internet display), please see our Data Protection page, which explains how to report it and how quickly we act.
11. Children
This website is intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
12. Third-party links and services
Our site links to independent partners through Hallmark® Concierge (mortgage, legal, insurance, inspection, moving, and related services) and to individual REALTOR® pages and external resources. Those organizations operate their own websites and privacy practices, and this policy does not apply to them.
13. Changes to this policy
We may update this policy from time to time. The current version is always posted here with its effective date. Material changes will be highlighted on the site.
