VOW Terms of Service

A Virtual Office Website is an Internet-based real estate brokerage service through which a real estate brokerage provides consumers with access to MLS® listing data for the purpose of supporting the consumer's search for real property. REMAX Hallmark® operates a VOW under authorization granted by the Toronto Regional Real Estate Board (TRREB), the Integrated Technology Solutions Ontario platform (ITSO), and the Naples Area Board of REALTORS® / Naples Area Multiple Listing Service (collectively, the “MLS Boards”).

Access to MLS® listing data through this VOW requires a registered user account and is subject to the rules and policies of the applicable MLS Board in addition to these terms.

• You must be at least 18 years of age to register.
• You must provide accurate, current, and complete information when creating your account.
• Only one account per individual is permitted.
• By registering, you acknowledge that you are a consumer who is working with or considering working with a REMAX Hallmark® REALTOR® in connection with a real estate transaction.
• REMAX Hallmark® reserves the right to verify your registration information and to refuse or revoke access at its discretion or at the direction of any applicable MLS Board.

Access to MLS® listing data through this VOW is provided exclusively for your personal, non-commercial use. Specifically, you may:

• Search for residential and commercial properties for your own purchase, sale, lease, or general real estate interest.
• Save and review listings within your registered account.
• Contact a REMAX Hallmark® REALTOR® to arrange viewings or request further information about specific properties.

You are expressly prohibited from using MLS® listing data accessed through this VOW for any of the following purposes:

• Reproducing, distributing, transmitting, publishing, or displaying listing data on any other website, application, or medium.
• Systematic downloading, scraping, harvesting, or aggregation of listing data by any automated or manual means.
• Creating derivative works or databases based on VOW listing data.
• Commercial use of any kind, including but not limited to valuation services, lead generation, data resale, or market analysis products.
• Sharing your account credentials with any other person.
• Using listing data in any manner that violates the rules, policies, or intellectual property rights of any applicable MLS Board.

MLS® listing data provided through this VOW is believed to be accurate but is not guaranteed. Listing information may be subject to change, omission, or error. Property details including price, availability, dimensions, taxes, and status are provided for informational purposes only and must be independently verified.

REMAX Hallmark® and the applicable MLS Boards make no representations or warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any listing data. You assume all risk associated with reliance on any information obtained through this VOW.

You are strongly encouraged to work directly with a REMAX Hallmark® REALTOR® to verify all property information before making any decisions.

Integrated Technology Solutions Ontario (ITSO)

Listing data for Ontario markets served through the ITSO platform is provided to consumers solely for personal, non-commercial real estate search purposes. Pursuant to ITSO board rules, certain listings display brokerage-level attribution only (“REMAX Hallmark®”); individual agent names are not disclosed on such listings as required by ITSO member board rules. Data is deemed reliable but accuracy is not guaranteed. All rights reserved by the applicable ITSO member boards.

Naples Area Board of REALTORS® / Naples Area MLS (SW Florida)

This VOW is operated pursuant to the Florida Realtors® and National Association of REALTORS® VOW/IDX policy. Listing content is offered by REMAX Hallmark® as a participating broker.

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify REMAX Hallmark® immediately of any unauthorized access to or use of your account.
• You may not transfer, assign, or share your account with any other person.
• You consent to receiving listing updates, market notifications, and communications from REMAX Hallmark® related to your registered property searches. You may unsubscribe at any time.

REMAX Hallmark® may suspend or terminate your VOW account and access to MLS® listing data at any time, without notice, for any reason including but not limited to: violation of these terms, violation of any applicable MLS Board rule or policy, at the direction of any MLS Board, or upon the cessation of your consumer relationship with REMAX Hallmark®.

Upon termination, all rights granted under these terms immediately cease. Provisions that by their nature should survive termination (including Sections 4, 5, 6, and 9) shall survive.

For Ontario, Canada properties and users: these terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the Province of Ontario.

For Florida, USA properties and users: these terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Collier County, Florida.
